[QUESTION] My state will be legalizing medical marijuana. How can I take advantage of this change from a business perspective without a license?

I am a new vape/smoke shop owner in Ohio and in September 2018, Ohio will legalize medical marijuana for some specified conditions. It’s definitely not a game changer for the state. I doubt it will be insanely popular due to restrictions and it won’t be recreational either. Demand for pipes and papers and things of that nature should increase, but I’m skeptical about how much it will go up by. Getting a license to sell medical cannabis is also out of the question (I think) because they issue such few licenses at a hefty price.

I’d like to know how I can prepare for this change to make more money for my new shop and any future changes in case it ever becomes recreational.

Side note: What are the laws about selling paraphernalia now if a customer says that they are purchasing a pipe for their legal marijuana? How should I handle that sort of thing?

  1. One thing is to realize that your potential customers are probably different from your current customers. Anything that seems like stoner/ headshop culture is kinda offputting to a lot of people. It’s worth a visit to Denver or Seattle or LA to see the diversity and sophistication of shops’ design and branding, what kinds of educational materials they’ve created, etc. There’s a lot of room in the high end of the market in particular, IMO. I think building a brand focused on understanding and serving senior citizens could be very successful. Just no tie-dye! 🙂

  2. It’s legal to use it for that. A lawyer might argue that you should check patient license or status, but I can’t see it being legal to ask about somebody’s medication. Only a lawyer can give you a good answer, but I can’t see how selling accessories for weed could get you in any trouble. Unless your laws are just crazy.
